Please read this document carefully. This document contains information on your rights, obligations, limitations, exclusions and legal standing.

Area of Application and Effectiveness - The contractual relationship between CalStrat and the Student enrolled in any Course provided by CalStrat shall be governed exclusively by this Contract which shall become effective and be binding on the parties at the time of acceptance, in writing, of Student´s application for admission by CalStrat or partner / affiliated institute / college / organization.
3. CalStrat hereby refuses to accept any additional or different terms contained on any of Student’s acknowledgments or in any other correspondence from the Student, unless such additional or different terms are expressly accepted in writing by CalStrat. The terms of this Contract shall constitute the entire agreement between CalStrat and the Student on the subject hereof, superseding all prior communications and negotiations between the parties.
4. Responsibility for Course Material – CalStrat will deliver the course material necessary to achieve the educational goals set forth in the academic curriculum. CalStrat does not guarantee that the Course Material will be errors- or omissions free.
5. CalStrat will deliver the Services to the Student in accordance with the rules and regulations set forth in the program guidelines
6. The Student will be responsible for inspecting the Course Material as soon as reasonably possible following delivery. Furthermore, the Student will be responsible for notifying us about any errors or omissions respective to the “Reading section” as outlined in the Course syllabus.
7. CalStrat reserves the right to make variations to the content or methods of delivery or assessment of Courses, to discontinue, merge or combine Courses as deemed fit by our committee without any prior notice.
8. In case the Student is intending to take leave (sabbatical) from the Course for a period of 15 days or more, the Student will be required to notify CalStrat in writing in advance. If Student fails to notify CalStrat in advance, continuation of the respective Course will be at CalStrat discretion.
9. All students must complete the entire Course within a period specified in the program guidelines. At the discretion of CalStrat and at the request of the Student the period of the course may be extended, for which an additional fee may be applicable.
10. Payments - The terms and dates of payment shall be as set forth in an invoice issued to the Student. The same will be mentioned in the product brochures.
a. Under no circumstances shall CalStrat be deemed to have received payment until payment has actually been received by CalStrat in full.
b. Preliminary access to the Course Material including online Learning System shall only be provided upon confirmed reception of the tuition payment (full or partial: consisting of the deposit, and first installment, relevant to the respective invoice).
c. Paid fees of the class room, distance learning and other online services are non-refundable.
d. CalStrat shall have the right to charge and receive a handling fee for late payment of 5% for outstanding dues not paid as per the terms set forth in the invoice or the product brochure.
e. CalStrat shall have, at any time, the right to suspend the Student’s access to the Course including but not limited to the Online Learning System if payment of any installment or subsequent installments is delayed for more than 7 days.
11. CalStrat shall not be obliged to issue the respective certifications or course completion letters until all outstanding dues are settled by the Student.
12. Termination
a. Without prejudice to any other rights CalStrat has, as per applicable law, should payment by the Student be delayed for more than 30 days per event, CalStrat shall have the right forthwith to terminate the contract upon written notification to the Student.
b. Likewise, CalStrat reserves the right to terminate the contract, without obligation to refund any of the paid tuition fees, in the following cases:
i. If Student is found guilty of plagiarism or serious academic misconduct in breach of CalStrat Student Regulations such as:
1. Academic Dishonesty
a. All forms of academic misconduct including but not limited to cheating, fabrication, plagiarism, or facilitating academic dishonesty.
b. Fabrication: is the falsification of any data used by students in any academic paper or document. This includes making up quotations, inventing data to suit the results wanted, omitting certain data to that is inconvenient to the experiment and also making up bibliographical references.
c. Plagiarism: is the theft of intellectual property belonging to another person and passing it off as one’s own work, or failing to cite the source of the original work properly. Examples of plagiarism are: handing in someone else’s work and passing it off as one’s own; copying ideas from other sources, without giving that source credit; giving incorrect information about the source or failing to use proper references; and using so many different ideas from other sources that the student barely uses any of their own work, whether it is properly referenced or not.
d. Forgery - Forgery, alteration, or misuse of any University document, record, key, electronic device, or identification. False information or Forgery of any documents used for the application.
e. Harassment - Harassment of any person by a student of CalStrat. For the purposes of these policies, ‘harassment’ is: the use, display, or other demonstration of words, gestures, imagery, or physical materials, or the engagement in any form of bodily conduct, on the basis of race, color, national or ethnic origin, alienage, sex, religion, age, sexual orientation, or physical or mental disability, that has the effect of creating a hostile and intimidating environment sufficiently severe or pervasive to substantially impair a reasonable person’s participation in University Courses or activities, or use of University facilities.
f. Course Material - Selling, preparing, or distributing course lecture notes or video or audio recordings of any course for any commercial purpose unless authorized by the University in advance and explicitly permitted by the course instructor in writing. The unauthorized sale or commercial distribution of course notes or recordings by a student is a violation of these Policies whether or not it was the student or someone else who prepared the notes or recordings.
g. Appropriate student conduct – CalStrat will not tolerate any harassment of, or threatening conduct towards, students, staff or faculty of CalStrat or affiliated institutes / organizations.. This includes e-mails or letters containing abusive or threatening language, as well as any false accusations intentionally made by a student against another student or a staff or faculty member, where the student knows the accusation to be false. Any negative comments or inappropriately aggressive behavior is not acceptable. Students must acknowledge any constructive criticism given by faculty or staff members.
h. Appropriate language - Faculty and staff members must be treated with respect at all times and students must reflect this in their general manner and tone of voice when addressing them. The authority of the faculty member must be recognized and other students must be treated in a courteous and appropriate manner.
13. Termination by the Student
a. The Student may terminate this contract upon 30 days written notice to CalStrat without the right for refund of any paid tuition fees. The same applies if the Student and CalStrat have agreed on installment payments so that the Student shall, irrespective of the termination of this contract, be obliged to pay the outstanding remainder of the tuition fees in accordance with the respective invoice to CalStrat
14. The Course Material supplied to the Student under this Contract shall always remain the exclusive property of CalStrat. All copyright and other intellectual property rights relating to the Course Material and the Online Learning System are either owned by or licensed to CalStrat
15. All Course Material and the CalStrat Online Learning System are intended for individual personal use and are protected under United States and International copyright laws and conventions and may not be published, copied, sold or otherwise reproduced or distributed without CalStrats’ prior written consent. CalStrat grants to the Student a non-exclusive license to use Online Learning System and the Course Material for Student´s personal learning only. This license cannot be shared by the Student with anyone else. The Student shall not use Online Learning System and the Course Material provided by SMC for any other purposes unrelated to the Course.
16. Limitation of Liability - The Services and Course offered by CalStrat do not constitute at any time the right of receiving a certification unless all requirements are successfully met.
17. CalStrat shall not be liable for any direct or indirect or consequential loss or damage whatsoever (including without limitation any loss of profits, loss of revenue, loss of opportunity) which the student may suffer arising out of or in connection with this contract, if CalStrat is acting slightly negligent only.
18. CalStrat neither guarantees nor warrants that the graduation/completion of a Course by a Student entitles the Student to receiving any degree and/or credit from another university or any other similar institution. The grant of a degree and/or credit by another university or similar institution is subject to the requirements determined in this respect by the respective university or similar institution only.
19. CalStrat shall not be obliged to issue a Diploma and the certificate of completion for the Course enrolled to those Students whose coursework and thesis/dissertation does not meet the graduation requirements or for those who do not pass final grand examination and defense as set forth in product brochures and updated from time to time.
20. CalStrat neither guarantees nor warrants that the Diploma issued to the Student constitutes a guarantee for enrollment, acceptance, and recognition at other universities, businesses, authorities, or governments. CalStrat neither guarantees nor warrants that the graduation/completion of a Course by a Student and/or the respective Diploma entitle the Student to the use thereof as official or academic title vis à vis authorities, universities or companies and/or in any kind of identity cards, other official documents, business cards, email signatories etc. Students are responsible and thus advised to check with their local authorities on the official recognition of the programs / credentials and certifications.
21. Data Protection - The Student is herewith informed by CalStrat in detail on the type, scope, place of and reason for the collection, processing, and use of personal data necessary to process orders, register for the Online Learning Platform and e-mail services, execute grading for submitted study work, and prepare admission documentation and academic transcripts and diplomas. Personal data of the customer is used for the following purposes:
a. To ensure the communication with the Student by e-mail and through the Online Learning System, incl. mails to all registered Students and registered applicants (mass mails).
b. To establish a Student profile
c. To continuously improve the quality of our Services
i. The Student expressly agrees to the collection, processing and use of personal data as described above.
22. Applicable Law and Place of Jurisdiction
a. This Contract shall be interpreted in all respects in accordance with the laws of State of California, United States. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is hereby expressly excluded.
23. The parties hereby submit to the exclusive jurisdiction of the California Courts for the determination of any question or dispute arising in connection with this Contract. Place of jurisdiction shall be California.
24. A student organization is any standing group that:
a. Is affiliated with one of the schools or the university
b. Distance learning or students of affiliates have to seek explicit permissions to be a part of or represent the same
c. Is entitled to seek funding and/or recognition through the Student Activities Council
d. Receives financial resources from the University, maintains a University banking account, reserves the use of a University vehicle, and/or uses a University organization telecommunications account
e. Uses University facilities
25. The University Alcohol and Drug Policy, like other standards of conduct applicable to the University community, is intended to further the educational mission of the University. The University is committed to fostering an environment that promotes the acquisition of knowledge and nurtures the growth of the individual. Each member of our intellectual community is responsible for his or her own actions and is expected to contribute to the CalStrat community and to respect the rights of others to participate in the academic and social life of the University. The following alcohol and drug policy, with its emphasis on individual and shared responsibility, healthy and informed decision-making, maintaining a caring environment, and the promotion of genuine dialogue, is adopted in this spirit.
a. Students, staff and faculty may be subject to additional requirements and procedures set forth by their respective schools or departments, and which may be stated in handbooks generated by those entities.
b. Standards of Conduct
c. CalStrat prohibits the unlawful manufacture, distribution, dispensation, sale, possession or use of any drug by any of its students, employees in its workplace, on its premises or as part of any of its activities.
d. Alcohol General Rules Governing the Use of Alcohol,
i. CalStrat seeks to encourage and sustain an academic environment that respects individual freedom and promotes the health, safety and welfare of all members of its community. In keeping with these objectives, the University has established the following policy governing the possession, sale and consumption of alcoholic beverages by members of CalStrat to encourage its members to make responsible decisions about the use of alcoholic beverages, and to promote safe, legal, and healthy patterns of social interaction.
e. CalStrat explicitly prohibits: and has guide lines towards:
i. The possession and/or consumption of alcoholic beverages by persons under the age of twenty-one on property owned or controlled by the CalStrat
ii. The consumption of alcoholic beverages by all University students and employees so as to adversely affect academic or job performance and/or endanger the physical well-being of other persons and/or oneself, and/or which leads to damage of property.
iii. The possession, sale, distribution, promotion, or consumption of an alcoholic beverage in a manner that constitutes a violation of federal, state or local law, including the sale, directly or indirectly, of any alcoholic beverages at a premise or by an entity not licensed for such sales on property owned or controlled by the University or as part of any University activity.
iv. CalStrat permits the lawful keeping and consumption, in moderation, of alcoholic beverages on its property or property under its control by persons of legal drinking age (21 years or older).
v. 3. In cases of intoxication and/or alcohol poisoning, the primary concern is the health and safety of the individual(s) involved. Individuals are strongly encouraged to call for medical assistance for themselves or for a friend/acquaintance who is dangerously intoxicated.
vi. The Dean, Directors and and heads of administrative and residential units have the authority and responsibility to govern the use of alcohol in areas they control, both indoors and out, and to approve or disapprove of plans designed to ensure that only legal age individuals will have access to such alcohol.
vii. Further, those hosting such events must take reasonable steps to ensure that the acquisition, distribution and consumption of alcohol otherwise complies with applicable law.
viii. At any event at which alcohol will be served, sufficient quantities of non-alcoholic beverages and food must also be available to guests without cost.
ix. Advertisements of social events shall not promote nor describe the availability of alcoholic beverages nor promote the consumption of alcohol by minors.
x. Rules Governing Alcohol Use at Registered Undergraduate Social Events

xi. Only individuals with valid proof of legal drinking age may be served alcohol; alcohol may nor be served to any visibly intoxicated person, regardless of age
xii. Alcohol may be served only from a controlled, designated area by sober, trained, of-age bartenders who are unaffiliated with the host organization.
xiii. Drinking contests or games of any sort are expressly prohibited
xiv. All registered events, either on-campus or at Third Party Vendors, must have appropriately trained bartenders who are unaffiliated with the host organization and who are at least 21 years of age.
xv. University trained and appointed monitors will assist in assuring that University policy is followed at all on-campus events.
xvi. The organizers of events must properly dispose of partially filled and empty alcohol containers at the conclusion of the event.
xvii. Violators of this policy will be subject to University disciplinary procedures.
26. Insurance and Travel
a. CalStrat strives to be a provider of superior services. However CalStrat does not undertake insurance, medical, travel or any other requirements arising out of the students affiliation of enrolment to CalStrat programs or services.
b. The same applies to faculty, corporate affiliations and research fellows / including PhD students.
c. Students and all concerned are advised to undertake precautions at all times and CalStrat does not guarantee any support in this. CalStrat does not assume any responsibility and bears no legal obligations for any losses arising out of travel to or for CalStrat.
